DATE : 06 MARCH 2017 P.C :

1] The entire enhanced amount involved in these two appeals is Rs.6,887/- and Rs.679/- respectively. The appeals relate to the year 1999. Till date, no effective steps have been taken, on account of which, even civil applications seeking condonation of delay cannot be disposed of.

2] For the reasons set out in Order dated 6 February 2017 in civil application no. 5080 of 2001 in First Appeal (Stamp) No. 12511 of 1999 [The State of Maharashtra vs. Jagannath S. Wabale] and other matters, these civil applications and consequently the appeals themselves are dismissed. The interim orders, if any, are hereby vacated.

3] In these matters, however, it is made clear that the rates determined by the Reference Court may not be taken as approved by this Court, particularly, taking into consideration the circumstances in which the civil applications and consequently the appeals have been dismissed.
