IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION APPEAL FROM ORDER NO.706 OF 2014 WITH CIVIL APPLICATION NO.849 OF 2014 Omkar B. Dongare & Ors.

...Appellants V/s.

Municipal Corporation of Gr. Mumbai & Ors.

...Respondents

Mr.Navin Tiwari for the Appellants.

Mr.A.V. Diwate for the Respondent - B.M.C.

CORAM : R.D. DHANUKA, J.

DATE : 9TH FEBRUARY, 2016.

P.C. :- 1.

Learned counsel appearing for the appellants states that his clients have already shifted to the alternate premises offered by the Municipal Corporation. He seeks liberty to file additional affidavit and to place on record that the alternate premises allotted to the appellants by the Municipal Corporation are not suitable. 2.

In my view since the appellants have already shifted from the suit premises to the alternate premises allotted by the Municipal Corporation, nothing survives in this appeal from order. The office is directed to accept the additional affidavit, if any, filed by the appellants during the course of the day.
