The learned counsel for the Applicant states that the Applicant was granted interim bail vide order dated 24/08/2021. She further states that during the pendecny of this application, charge sheet has been filed against the Applicant before 37th Court, Esplanade, Mumbai. She therefore seeks leave to withdraw the application with liberty to file fresh application before the Trial Court within a period of one month. Leave with liberty as prayed for is granted.

Learned counsel for the Applicant states that the application will be filed within one month. The Trial Court to make an endeavour to dispose of the bail application as expeditiously as possible and in any event within a period of three months from the date of filing of the bail application. The interim bail granted by this Court shall continue till such bail application is decided on merits.

It is made clear that this Court has not gone into the merits of the matter. Fresh application, if filed, the Metropolitan Magistrate, 37th Court, Esplanade, Mumbai, shall decide the same on its own merits in accordance with law.

The application is dismissed as withdrawn.
