Dusane 2/2 WP514-515 The challenge to the order impugned in this petition is from both the sides. The petitioners challenge the order as well as finding against them, whereas the respondent challenges only the findings against it. There is an affidavit-in-reply filed for the purpose. After the petition was substantially heard, both the counsel state that the Complaint (ULP) No. 486 of 1989 and Complaint (ULP) No.487 of 1989 be remanded to the Industrial Court for fresh hearing on the basis of evidence, which has already been recorded. In view of the statement made, the petitions are allowed. The orders dtd. 31st January, 1997 in Complaint (ULP) No. 486 of 1989 and Complaint (ULP) No.487 of 1989 are set aside. The complaints are remanded to the Industrial Court for fresh hearing.

The Industrial Court shall hear the parties afresh on the evidence already recorded and pas`s it's order in accordance with law. The Industrial Court is directed to dispose off both the complaints within a period of three months from today. It is made clear that all the contentions of both the sides are kept open for the consideration of the Industrial Court.
