By this Application, the Applicants apprehending arrest, in connection with investigation of Crime No.72/2021 of Police Station Azadnagar, Malegaon, under Section 384, 386, 343, 504, 506 and 323 r/w. Section 34 of IPC, are seeking anticipatory bail. The aforesaid offence is registered on the basis of complaint lodged by Mukhtar Ahmed Abdul Gafoor.

I have heard the learned counsel for the parties. Perused record.

It appears that there is a monetary dispute between the parties which has given rise to the present FIR. The record discloses that on 24 August 2021, this Court passed an order that no coercive steps shall be taken against the Applicants, which order has been extended from time to time. Today, the learned counsel for the Applicants has produced affidavit of the Complainant Mukhtar Ahmed Abdul Gafoor alongwith Memorandum of Understanding, by which it is stated that the dispute has been resolved.

Learned APP, in such circumstances, has fairly submitted that this Court may pass appropriate orders directing the Applicants to join the investigation.

In such circumstances, the following order is passed.

ORDER

(i) In the event of their arrest, in connection with investigation of Crime No.72/2021 of Police Station Azadnagar, Malegaon, the Applicants be released on bail on executing a P.R. Bond in the sum of Rs.25,000/- each with one or two solvent sureties each in the like amount.

(ii) The Applicants shall report to the Investigating Officer on 21/2/2022 and 22/2/2022 between 11.00 Mamta Kale page 2 of 3

a.m. to 1.00 p.m. and shall cooperate with the Investigating Agency.

(iii) The Criminal Application is disposed of, in the aforesaid terms.
