Heard the Petitioner appearing in persons. The grievance in this Petition under Article 226 of the Constitution of India is that the suit of the year 2007 filed by the Respondent is still pending in the Small Causes Court, Mumbai. The prayer in this Petition is for fixing a time-bound programme for the disposal of the suit. A judicial notice of the fact will have to be taken that the Small Causes Court is having large pendency of older suits and proceedings than the suits of the year 2007. Therefore, it is for

the Court before which the suit is pending to decide whether priority deserves to be given to the suit of the year 2007. The contention of the Petitioner appearing in person that the suit has been already expedited. If that be so, the Petitioner should have no grievance. By granting liberty to the Petitioner to move appropriate Application before the concerned Court, we dispose of this Petition.
