None appears for the Petitioner though called out in both the sessions. The Learned Counsel appearing for the Respondent Mr. Keluskar states that during the pendency of the above Petition, the Petitioner had approached the District Consumer Forum, Sangli, in respect of the subject matter of the above Petition as also claiming the same relief. The complaint filed by the Petitioner has been allowed by the District Consumer Forum, against which the Learned Counsel states that, the Bank has filed an Appeal before the Maharashtra State Consumer Dispute Redressal Commission. It is probably for the aforesaid reason that no appearance is put up on behalf of the Petitioner today. This Court is therefore constrained to dismiss the above Petition for non prosecution. The judgment dated 16-1-2016 is taken on record and marked as "X" for identification.
