The learned counsel for the appellant on instructions seeks leave to withdraw the appeal. The appeal is accordingly dismissed as withdrawn, with no order as to costs. 2.

The appellant shall be entitled to the refund of Court Fees, as per Rules. The amount of Rs.25,000/- deposited before this Court along with interest, if any, shall be made over to the Motor Accident Claims Tribunal at Kolhapur. The Tribunal shall pass appropriate order for payment of the compensation to the respondent No.1 (Original Claimant).
