The Criminal Appeal of the present applicant challenging the Judgment and Order dated 29/3/2007 by which he was convicted by the Ad hoc Additional Sessions Judge, Pune for the offence punishable under section 498A and 306 of the Indian Penal Code is confirmed by the Judgment and Order of this Court dated 22/9/2020. The sentence imposed upon the applicant by the Ad-hoc Additional Sessions Judge, Pune is enhanced by this Court and he is sentenced to Talwalkar
4.IA7313.2020.doc suffer R.I. for 5 years. This Court had directed the applicant to surrender before the Second Additional Sessions Judge, Pune within 4 weeks from the date of the Judgment.
By this application, the applicant is seeking extension of time to surrender before the Sessions Court. It is reported that the applicant has tested positive for COVID-19 and was under treatment from 3/12/2020. The learned Counsel has placed on record the medical certificate issued by Primary Health Center, Umbraj, Taluka Karad. In view of this, time to surrender is extended upto 15/1/2021. The applicant shall surrender before the learned Additional Sessions Judge, Pune on or before 15/1/2021. Upon failure to surrender, the Additional Sessions Judge, Pune shall issue a nonbailable warrant against the applicant. The application stands allowed and disposed of accordingly.
