On earlier date i.e. 25th July 2022, none appeared for the petitioner and in view of order of this Court dated 16th June 2022, notice was issued to the respondent no. 2 - Sandip Golait. 2.
Today, the learned counsel for the petitioner submits that due to personal difficulty, the counsel for the petitioner was unable to attend the Court on earlier date. Accordingly, Caste Scrutiny Committee, Nashik passed the order on 11th July 2022, whereby the claim submitted by the petitioner for validation is decided. 13-cp-340-2022.doc of the petitioner. The counsel submits that the petitioner may take appropriate remedies challenging the order dated 11th July 2022 before the competent forum as a judicial or otherwise. 3.
Considering the fact that before the order of this Court dated 25th July 2022, the caste claim of the petitioner was already decided and the petitioner is now desirous of challenging the said order. The order of this Court dated 25th July 2022, issuing notice to the respondent no.2 under rule (9) of Chapter XXXIV of the Bombay High Court, Appellate Side Rules, 1960 is recalled and as the grievance in the petition is no more survives. The petition is accordingly disposed of.
