DATED : 13th JULY, 2022 P.C:- The applicant is accused of forging and fabricating an order issued under the signature of the Under Secretary to the Government of India, Consumer Foods and Public Distribution Department dated 2/11/2018, nominating him as Member of the Consultative Committee of the Food Corporation of India for the State of Maharashtra for a period of two years or until further orders, whichever is earlier.

This order is apparently fraudulent and has resulted in registration of C.R with Kasturba Marg police station on 27/11/2020 on report of Assistant, Grade-II Manager in the Food Corporation.

2/3 27 ABA 1883-22.doc The applicant face the accusation of forging the said nomination letter, and on investigation from the Assistant General Manager for the FCI, it is revealed that no such order has been issued by the Department of Food and Public Distribution, Ministry of Consumer Affairs, New Delhi.

It is apparent that the said letter is forged, but the stand of the applicant is, he was handed over the said order by one Vikas Baburao Jagtap, after service of 30 years, when he sought voluntary retirement to serve the public at large, he was issued with the order by Shri Jagtap. It is informed that Shri Jagtap is no more alive to ascertain the aforesaid statement. In any case, the applicant did not derive any benefit from the said order, since the appointment was only for a period of two years. The complaint being registered in the year 2020, when the period of nomination have already expired, definitely do not warrant any custodial interrogation. Hence, the following order :-

O R D E R

(a) In the event of his arrest, the Applicant - Ganpat Seshrao Pawar in connection of C.R.No.1179/2020 registered with Kasturba Marg police station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.

3/3 27 ABA 1883-22.doc (b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.

(c) The Applicant shall report to the concerned police station from 18th July to 20th July 2022 between 3.00 p.m to 5.00 p.m and thereafter as and when called
