The above Letters Patent Appeal was on board yesterday i.e. 14-62017, when none had appeared for the Appellant and was therefore kept today as a last chance. Today also no appearance is put up on behalf of the Appellant. The orders passed in the past also indicate that there have been intermittent default in appearance on behalf of the Appellant. We are therefore constrained to dismiss the above Letters Patent Appeal for non prosecution.

In view of the dismissal of the above Letters Patent Appeal, the Civil Application (L) No.242 of 2009 does not survive and to accordingly stand disposed of.
