The Petitioner claims entitlement to receive in service and post retirement benefits. The petitioner contends that at the relevant time he was compelled to tender resignation and the same was not voluntary in nature. It appears that the petitioner became aware of the compulsion and pressure exercised by the respondent only after lapse of 25 years. There is absolutely no explanation as regards delay occurred in approaching either the employer or this Court.
Petition is not liable to be entertained on account of unexplained delay on the part of the petitioner. No interference is called for in exercise of extra ordinary jurisdiction under Article 226 of the Constitution of India. Petition is rejected. (V. M. DESHPANDE, J) (R.M.
