The offence alleged against the Petitioner is one punishable under Section 376 of the Indian Penal Code. The learned Additional Public Prosecutor Shri Avinash Kamkhedkar states that charge-sheet has been filed on 15/02/2017. In view thereof, the learned counsel for the Petitioner Shri Nikam seeks withdrawal of the above Writ Petition to take appropriate recourse in the Trial Court. The above Writ Petition is accordingly allowed to be withdrawn and dismissed as such. Needless to state that if any application for discharge is filed, the same would be heard and decided on its own merits and in accordance with law.
