The report is received from learned Mediator informing that the mediation has failed and no settlement is arrived between the parties. A report dated 14/09/2022, is taken on record. 2.

I would like to place appreciation to the efforts taken by the learned Senior counsel Shri. Rafique Dada, in his endevour to mediate between the parties. The appreciation shall communicated to learned Senior counsel.

Heard learned counsel for the complainant.

The Investigating Officer, who is present in the court make a categorical statement, through learned APP that the custodial Ashish Mhaske

In the wake of the above the applicant deserve protection from arrest by the following order.

O R D E R

(a) By way of ad-interim order, in the event of his arrest, the Applicant - Nimit Shobhnath Dubey in connection with C.R.No.0502 of 2021 registered with Kashimira Police Station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.

(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.

(c) The Applicant shall report to the Police Station as and when directed by the Investigating Officer. 6.

The application is disposed off accordingly.
