This is an application for anticipatory bail in connection with C.R.No.I-65/2019 registered with Valiv Police Station, Vasai, Dist. : Palghar punishable under Sections 498-A, 406, 323, 504, 506 read with 34 of Indian Penal Code.

The applicant is the husband of complainant. It was alleged that the complainant was harassed by the husband and in-laws. The applicant was granted interim protection by order 18th June 2019. Subsequently, the complainant was directed to be added as a respondent.'

Learned Counsel for the applicant, however, on instructions, Manjusha

20 ABA 1290-2019.doc submits that both the parties have decided to file Petition for Divorce by mutual consent before the Family Court bearing No.237/2020 and it is pending for hearing. It is due for hearing on 2nd March 2021. 4.

In these circumstances, interim order granted by this Court can be confirmed.

Hence the following order.

O R D E R

(i) Anticipatory Bail Application No. 1290 of 2019, is allowed;

(ii) In the event of arrest of the applicant in C.R.No. I 65 of 2019, registered with Valiv Police Station, Vasai, Dist. : Palghar, the applicant be released on bail on executing P.R. bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

(iii) Anticipatory Bail Application No.1290 of 2019, stands disposed of.
