By this petition the Petitioner challenges the orders passed by the Labour Court Sangli dated 19 June 2015 and the Industrial Court rejecting the application for interim relief filed by the Petitioner.

The Petitioner was working as a Gram Sevak. It is his case that he was appointed against the post reserved for Sports Person in open category as he had participated in State Level Sports Competition. He filed a Complaint (U.L.P) No.18/2012 in Labour Court Sangli, since he was apprehending termination and sought interim relief, which was rejected by the Labour Court by order dated 20 June 2013. The Petitioner thereafter filed a Revision (ULP) No.30 of 2013 against the order rejecting interim relief. The

Revision application was rejected on 19 June 2015 and the statusquo was continued till 19 July 2015. 3.

The learned counsel for the Respondents has pointed out, relying on the reply filed by the Respondents, that the services of the Petitioner have been terminated on 31 August 2015. In view of this position, the Petition arising from interim order does not survive any further.

The complaint filed by the Petitioner is pending. The Petitioner can always take out an appropriate application in the complaint, which will be decided on its own merits. The learned counsel for the Petitioner submitted that the Petitioner has filed a Writ petition No.3985 of 2012 which is pending before the Division bench of this Court, challenging the action of the State government which has led to the passing of the order of dismissal by the Respondent-Zilla Parishad. The Petitioner can always take out an appropriate application in the Writ petition, on merits. In view thereof, it is not necessary to keep present petition pending and it is disposed of as infructuous.
