The learned APP on instructions states that the 'B' Summary is being prepared by the Investigating Agency and the same will be submitted to the concerned Magistrate within a period of two weeks. As per the position of law, if the 'B' Summary is filed, the Petitioners have an opportunity to put-forth a say and contest the

29. WP 3075.21.doc 'B' Summary and the learned Magistrate has the power under law to issue necessary directions including not accepting the 'B' Summary on its own merits.

In that light of the matter, keeping all contentions of the Petitioners open on merits and recording the statement of the learned APP that the necessary report will be submitted within a period of two weeks with notice to the Petitioners, we dispose of the Petition.
