Today, when the petition is called out none appears for the petitioner. Mr.Datar, the learned counsel for the respondent submits that the respondent has informed him that the petitioner has already expired.

Till date, no steps have been taken to bring on record the legal representative of the petitioner, in case, such legal representatives are really interested in pursuing this petition. 3.

In the aforesaid circumstances, this petition, which relates to the year 1997 is dismissed for non-prosecution. This shall, however, not preclude the petitioner from taking appropriate steps for restoration.
