Heard Mr. Dhumatkar, learned Counsel for applicant and Mr. Shukla, learned Counsel for respondent No.1. 2.
Learned Counsel appearing for the parties submit that the parties have tendered consent terms in Suit No.173 of 2006 and the Suit was disposed of in terms of the consent terms on 08.03.2016. They have tendered photocopy of the order dated 08.03.2016, which is taken on record and marked 'X' for identification.

In view of this, Mr. Dhumatkar seeks permission to withdraw the Application. Mr. Shukla has no objection.

In view thereof, C.R.A. is allowed to be withdrawn. 5.
Mr. Shukla also seeks permission to withdraw S.C.Suit No.1942 of 2014 pending on the file of City Civil Court, Dindoshi, Mumbai. Mr. Dhumatkar has no objection.

Leave as prayed for is granted. Respondent No.1 is permitted to 1/2
CRA388_15.sxw withdraw S.C.Suit No.1942 of 2014. Respondent No.1 shall produce authenticated copy of this order so as to enable the learned trial Judge to pass further orders. R & P shall be transmitted to the City Civil Court, Dindoshi, Mumbai forthwith.
