Heard Mr. Kapre, learned Counsel for petitioner. 2.

By order dated 23.06.2017, Mr. G. D. Tadvalkar (retired District Judge) was proposed to be appointed as Sole Arbitrator for adjudicating the dispute and differences between the parties. The prospective Arbitrator was requested to submit statement of disclosure in writing in terms of Sections 11(8) and 12(1)(b) of the Arbitration and Conciliation Act, 1996 (for short 'Act'). The prospective Arbitrator was to disclose in the statement of disclosure whether he can make award within a period of 12 months from the date of arbitral Tribunal entering upon the reference under Section 29-A of the Act.

In pursuance thereof, the prospective Arbitrator has forwarded covering letter dated 12.07.2017 along with the 1/2

ARP34_15.doc statement of disclosure as per the Sixth Schedule. The prospective Arbitrator stated that he does not have any concern or interest of whatsoever nature with any of the parties or related persons concerned and that he will make endeavor to complete the proceedings within the stipulated time. The covering letter along with the statement of disclosure are taken on record and marked 'X colly.' for identification.

In view thereof, I appoint Shri G. D. Tadvalkar, retired District Judge as a Sole Arbitrator. The parties as also office shall transmit copy of this order to the learned Arbitrator forthwith.
