Rule. By consent rule is made returnable forthwith. 3.
The case of the Petitioner in brief is that his application for furlough was rejected. However, furlough was granted by this Court on deposit of Rs.10,000/-. Thereafter he has been released on five times on furlough on deposit of Rs.10,000/- 4.
Prayer of the Petitioner is that thereafter when he is released on furlough he should released on furlough on deposit of Rs.5000/- on account of his poor financial condition. Megha 1/2

The learned APP has brought to our notice that in fact the Petitioner has expired on 25.7.2015 in CPR Hospital, Kolhapur. A report to that effect is taken on record and marked 'X' for identification. The learned APP on instructions states that an amount of Rs.2000/- which was given as a security deposit is lying with the prison authority of Kolhapur Central Prison, Kalamba. Said amount be handed over to Manoj subhash Khot the legal heir of the Petitioner.

In view of the above, no case is made out for reducing the amount from 10,000/- to Rs.5,000/-. Rule is discharged. (SMT. ANUJA PRABHUDESSAI,J.) (SMT. V.K. TAHILRAMANI,J.) Megha 2/2
