The Petitioner had filed an application before the Joint Charity Commissioner at Latur invoking the provisions of section 51 of the Maharashtra Public Trusts Act. Since the Joint Charity Commissioner was not available, the Petitioner approached this Court for continuation of the interim relief initially granted in their favour in R.C.S. No.7 of 2005 by the Additional District Judge, Solapur.

Mr. Khairdi, learned Counsel appearing for the Petitioner submitted that powers of the Joint Charity Commissioner exercisable under section 51 of the Act are delegated to the Assistant and the Deputy Charity Commissioners at Solapur, and his application is transferred to the office of patilsr 1 / 2

Deputy Charity Commissioner, Solapur and it is numbered as 342 of 2014.

In above circumstances, we find that there is no need to keep this writ petition pending and the same is disposed of by directing the Deputy Charity commissioner, Solapur to dispose of Application No.342 of 2014 filed by the Petitioner under section 51 of the said Act as expeditiously as possible and at any rate within the period of six weeks from the date of receipt of a copy of this order. Ordered accordingly. 4.

Till the disposal of the Petitioner's application under section 51, ad-interim relief granted by this Court on 7th March 2014 shall remain in operation.

Writ petition stands disposed of.
