DATED : 19th SEPTEMBER 2022 P.C:- The learned APP has placed on record the report from the Medical Officer, Kalyan District Prison, Class-I dated 3/9/2022.

The report state that the prisoner was having swelling and pain over right chest region and therefore, and therefore, he Tilak

2/2 67 BA 2036-22.doc was forwarded to Sir J.J. Hospital, Mumbai. He was examined by Chest Physician and referred to Surgery and found that there was a swelling.

A USG and FNAC of breast swelling was carried out which was likely suggestive of focal nodular ayanaecomastia in right breast, but ultimately the report of FNAC dated 21/8/2022 reflected as under :- "Benign Breast lesion suggestive of gynecomastia" Since the report state that the condition of the patient is non-emergent and no intervention is required and he has been prescribed medicines, there is no medical emergency. The report of the Medical Officer dated 3/9/2022 is taken on record and marked "X" for identification. Needless to state that he shall be continued to offered the treatment for his pain and illness.

Accepting the aforesaid report, application is disposed off.

Needless to state that any further medical emergency would permit the applicant to approach this Court once again. In view of the disposal of the Bail Application, Interim Application do not survive and is disposed off. ( SMT. BHARATI DANGRE, J.) Tilak
