Perused the report dated 6th September 2016 forwarded by the learned Judicial Magistrate, First Class, Cantonment, Pune, along with a report dated 16th September 2016 submitted by the learned Chief Judicial Magistrate, Pune. On the basis of the record, the learned Judicial Magistrate, First Class has stated that in C.R. No.296 of 2005 which is subject matter of this Application, the report claiming "C" Summary was submitted and that the "C" Summary was granted.

In view of the said report and in view of the fact that the "C" Summary has been granted, nothing survives in this Application for quashing the First Information Report. Accordingly, the Application is disposed of. Rule is discharged with no order as to costs.
