IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITON NO. 2776 OF 2015 Mr. Onkar @ Gubya Arun Tapase and ors.

....Petitioners versus Superintendent of Police and ors.

....Respondents Mr.P.M. Patil for the petitioners.

Mr. K.V.Saste, APP. for the Respondents.

CORAM : RANJIT MORE & ANUJA PRABHUDESSAI, JJ.

DATED : 31st July, 2015.

P.C.:

By this petition the petitioners have challenged the externment order dated 24th June 2015 passed under Section 55 of the Bombay Police Act, 1951. Learned Counsel for the petitioners does not dispute that the order impugned is appellable under Section 60 of the Bombay Police Act, 1951. In that view of the matter, we are not inclined to exercise our writ jurisdiction under 227 of the Constitution of India. Petition is dismissed.

2) The petitioner is, however, at liberty to file appeal against the impugned order and if the appeal is filed within two weeks from today, the Appellate Authority shall dispose of the same as expeditiously as possible and preferably within a period of three weeks from the date of filing of the appeal.
