The learned counsel for the Applicant submits that application filed by the Applicant under section 439 of the Code of Criminal Procedure, 1973 before the Sessions Court at Solapur was rejected on 16/06/2016 and thereafter, charge-sheet has been filed. In view of this, the learned counsel for the Applicant seeks liberty to withdraw the application. 2) The liberty as prayed for is granted in the interest of justice with further liberty to approach the Court of Sessions in the changed circumstances. The learned Sessions Judge shall decide the application on its own merits, without being influenced by the withdrawal of this application. 3) Application stands dismissed as withdrawn.
