The application is moved for pre arrest bail as the applicant/accused is facing charges for the offences punishable under Sections 326, 147, 149, 323, 504 and 506 of the Indian Penal Code in C.R. No. 49 of 2015 registered with Tembhurni police station, Solapur.

It is the case of one Arun Bodare who is the complainant that his family and the family of the applicant/accused and one 1 / 3
Shirtode family are on inimical terms because of the dispute about the land. On 15th March, 2015 the complainant found that the coaccused were unnecessarily switching off the lights by taking of the fuse from the public road and therefore he objected to the same. There were verbal altercations between the co-accused and the complainant. Thereafter the complainant approached the mother of the co-accused and informed her. On the next day on 16th March, 2015 in the morning the applicant/accused and other accused came near the house of the complainant and they started quarreling with him. Then suddenly two accused Hanumant Bodare and Bandu Shirtode took sticks which were lying outside the house of the complainant and started assaulting him. The applicant/accused also assaulted the complainant with kicks and fist blows. The complainant got injured. Hence, he gave information to the police. 3.
The learned counsel for the applicant/accused has submitted that out of the co-accused, some of them were released on bail. He submitted that the applicant/accused is innocent and he did not assault the complainant with any weapon.

The learned prosecutor opposed the application. He submitted that at present the investigating officer did not bring the injury certificate.

Perused the first information report. A left hand of the complainant was fractured because of the injuries caused by Hanumant Bodare and Bandu Shirtode. The applicant/accused Raju Bodare is attributed the role of assaulting the complainant with fist and kicks blows only. In view of this, the interim pre arrest bail granted earlier to the applicant on 20th July, 2015 is hereby confirmed on the same terms and conditions. Now the attendance is to be given as directed earlier, till filing of the charge sheet. 6.
