Learned counsel for applicant at the outset submits that the applicant is in custody from 14th May 2017. It is submitted that there is no progress in the trial. He tendered roznama of the proceedings. Learned APP submits that the case is kept for framing charge on 21st January 2021. On instructions it is submitted that prosecution intends to examine 12 witnesses.

In view of aforesaid submission, learned counsel for applicant, on instructions, seeks leave to withdraw this application. However, it is submitted that considering the fact that applicant is in custody for a period of about three years, the applicant be granted liberty to prefer fresh application for bail in the event trial is not concluded immediately.

In view of this submission, the Bail Application is allowed to be withdrawn and disposed of. In the event trial is not concluded within six months from the date of receipt of copy of this order by Trial Court, the applicant will be at liberty to prefer fresh application for bail.
