Applicant is seeking regular bail in Crime No. 31 of 2019 registered with the Kadegaon Police Station, District Sangli for the offences punishable under Section 302 and 307 of the Indian Penal Code.
It is the prosecution's case that on the date of occurrence, applicant was called by informant to ask about his love affair. When applicant came, there was conversation, in which, applicant got annoyed and took out the knife from his pocket and assaulted in all three persons. Particularly, he assaulted informant - Sandip, deceased Pradeep and a lady namely - Sharda Shinde. Later on Pradeep succumbed to stab injury and, therefore, the report.
Applicant's learned Counsel would submit that it is a case of false implication. The witnesses are related to each other. The accused is languishing in jail since long and trial will take long S.R.JOSHI

In the concerned incident, applicant had assaulted in all three persons by means of knife. Post Mortem note discloses that Pradeep sustained several stab injuries at his stomach which resulted into death. Injury certificate of informants also shows that he sustained stab injury. There are three to four eye witnesses. Clothes were seized at the instance of the accused. Having regard to the seriousness of offence and the evidence collected during investigation, it is not a fit case for releasing applicant on bail. True, the applicant is in jail since 23rd March, 2019 and, therefore, certain directions are needed. In view of that, following interim order:-
O R D E R
(i) Application stands rejected.
(ii) The learned Trial Judge is requested to expedite the trial and conclude the same within six months from the date of receipt of this intimation.
