The learned Sr. Counsel Mr. Thorat appearing on behalf of respondents makes a statement that in view of order dated 10.04.2013 passed by Bombay City Civil Court at Bombay in S.C. Suit No. 815 of 2013, he received instructions to withdraw the Notice of Motion no. 231 of 2012 in S.C. Suit No. 219 of 2012 filed by them. Same is allowed.

Notice of Motion no. 231 of 2012 stands dismissed as withdrawn.

The learned Senior Counsel Mr. Shah for the appellant submits that in view of subsequent Sneha Chavan 1/2
