After hearing the learned Counsel for the petitioner/husband elaborately, this Court feels that the petition does not deserve any consideration for the reason that what is sought to be questioned in the instant petition is discretionary, Order passed by the learned trial Magistrate which is confirmed by the learned Additional Sessions Judge in an appeal. After a round of litigation, ultimately aggrieved person/wife was succeeded in getting a meager amount of Rs.35,333/- towards expenses of school of the child of the couple. The child is with the wife/aggrieved person. The Order passed by the learned trial Magistrate directs actual reimbursement of the Gaikwad RD 1/2
(5)WPNo.31602019.odt school expenses incurred by the wife. The said Order is upheld by the learned Additional Sessions Judge in appeal. The discretionary Order passed by the learned trial Magistrate cannot be faulted with as it directs reimbursement of actual expenses of school of the child of the couple.
Hence, the Writ Petition is rejected.
