Learned counsel for the respondent-society has filed an Affidavit of one Mr. Robert D'silva. The said affidavit is taken on record. 2.

Perused the affidavit and letter dated 07.09.2017 written to the Asst. Municipal Commissioner, Mumbai Municipal Corporation by the respondent-society. In the said affidavit, it is mentioned that water pipe line is already constructed from other adjacent plot and not from the society.

In view of the above, cause of action does not survive and the Appeal from Order is disposed of.
