The Civil Application is allowed in terms of prayer clauses (a) and (b) which are reproduced here-under : "(a) The delay caused in filing the present appeal be condoned and the abatement of the Second Appeal No.667 of 1996 as against Appellant No.1 Shri. Digamber Bhagwan Bagave be set aside.
(b)The legal heirs and representatives of appellant No.1 Shri Digambar Bhagwan Bagave as shown in the title of this application be brought on record and the title of the appeal memo be amended accordingly. "
