Though respondent nos. 1 & 2 duly served, no one appeared on behalf of them when the matter is called out. By this Civil Application, applicant-original claimant is seeking

2 60.3223.17 caf.doc condonation of delay of 21 days in filing First Appeal challenging the Judgment and Award dated 27/02/2017 passed by Motor Accident Claim Tribunal, Sindhudurg at Oros in Claim Application No. 12/2015.

Consideting the submissions made by the learned counsel for the applicant and the averments made in Civil Application, I am satisfied that applicant has made out case for allowing the Civil Application. Hence, following order:

(I) Delay of 21 days in filing the First Appeal is condoned.

(II) Civil Application stands disposed of.

(III) No order as to costs.
