OPERATIVE PART OF THE JUDGMENT :

For the reasons dictated in the open Court, the following is the order passed in these appeals:

(i) The conviction and sentence of the appellant (accused No.9Sidharam Shivkaran Mangrule) imposed under the impugned judgment and order dated 7th June 2012 passed by the learned Ad hoc Additional Sessions Judge, Solapur in Sessions Case No.144/2008 is hereby quashed and set aside and the appellant is acquitted from the offences against him;

(ii) The order passed regarding Muddemal articles is confirmed; (iii) The appellant shall be forthwith set at liberty provided he is not required in connection with any other offence; (iv) The appeal is allowed in the above terms; (v) All concerned to act on an authenticated copy of the operative part of the order.
