By the present application, the applicant seeks his release on bail in the wake of an event of his brother having expired on 10/07/2022 at his native village Karkala, DistrictUdupi, State of Karnataka and according to the applicant, since he is the elder brother, he needs to be participated in his last rituals.

The applicant faces accusation in C.R.No.176 of 2022 for the offences punishable under Sections 307, 120(B), 353, 333,
2/3 34 IA-2193-22.doc 332, 326, 109, 143, 147, 148, 149, 427, 504, 506, 395, 324, 336, 337, 338 of the Indian Penal Code, Section 135 of the Bombay Police Act, Section 7 of the Criminal Law Amendment Act and Section 3(1) of the Prevention of Damage to Public Property Act, 1948.

Learned A.P.P. Mr.Gavand states that considering the fact that the applicant needs to travel to Karkala, some arrangement can be made for he attending the last rites. In the wake of the emergent situation, the learned counsel for the applicant has instructions to state that he is ready to bear the expenses of the escort ans travel, if at all he is permitted to travel to village Karkala, District-Udupi, State of Karnataka. 4.
In the wake of the above statement, the applicant shall be permitted to travel to village Karkala, District Udupi, State of Karnataka with minimum two police personnels by train. 5.
The applicant shall bear the expenses of escort, including their travelling charges and the other charges, which are fxed as per the procedure. Upon such deposit, the applicant is permitted to travel to village Karkala, District Udupi, State of Karnataka and stay there for a period of two days, excluding the period of travel to and fro.
