This is an application for anticipatory bail. The applicant is apprehending arrest in connection with C.R.No.785 of 2020, registered with MIDC Police Station, Andheri, Mumbai, for the ofences punishable under Sections 420, 408 and 406 read with 34 of Indian Penal Code ("IPC", for short). rpa 2/3 37 aba 1110 2020.doc accused had acted in connivance, and, by submitting false bills misappropriated an amount of Rs.4,12,291/-.

The applicant was granted interim protection by this Court vide order dated 28th December, 2020, on certain terms and conditions. Thereafter, by order dated 7th January, 2021, this Court had noted that the learned counsel for the applicant, on instructions, submitted that the applicant is willing to show his bonafide by depositing substantial amount. He would deposit Rs.1,00,000/-, on or before 31st January, 2021, and, thereafter, Rs.50,000/-, per month to make up the amount of Rs.4,00,000/-. Learned APP submitted that the details of the deposits made by the applicant, indicate that the amount of Rs.4,00,000/-, has been deposited by the applicant. In view of the aforesaid circumstances, the applicant need not be subjected to custodial interrogation. The interim protection granted to the applicant can be confirmed by allowing this application.

(i) Anticipatory Bail Application No.1110 of 2020, is allowed;

rpa 3/3 37 aba 1110 2020.doc (ii) In the event of arrest of the applicant in connection with C.R.No.785 of 2020, registered with MIDC Police Station, Andheri, Mumbai, the applicant be released on bail on executing P.R. Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount;

(iii) Anticipatory Bail Application No.1110 of 2020, stands disposed of accordingly.
