By this application the prosecution has sought the cancellation of pre arrest bail granted in favour of the respondent vide order dated 29-112012 by this Court. The application is mainly founded on the ground that while passing the said order the applicant was asked to deposit the amount of Rs. 8 lacs within a period of three months, but the applicant failed to do it.

The learned APP in all fairness has submitted that today the investigating officer has given a report stating therein that the said amount of Rs. 8 lacs is belatedly paid by the applicant in November, 2013 through R.T.G.S.

Thus, there being substantial compliance of the order though belatedly, it is difficult to accept the prayer for cancellation of bail. As a matter of fact due to the said belated payment on the part of the respondent the cause for the application does not survive.
Application stands disposed of as not survive.
