The learned APP has submitted a report dated 23rd June 2016 signed by the Assistant Police Inspector of Kondhwa Police Station, Pune. The report records that it was decided to claim "C" Summary and the matter is pending for formal approval of the Assistant Commissioner of Police. 2.

We direct the Police to file a report claiming "C" Summary as expeditiously as possible before the learned Magistrate.

In view of the aforesaid directions, it is not necessary to entertain the present Application for quashing the First Information Report at this stage. Accordingly, we dispose of the Application. In the event, the learned Magistrate rejects the prayer for grant of "C" Summary, it will be open for the Applicant to file a fresh Application for the same relief.
