2/2 9 ABA 1895-22 modified.doc station and has placed on record the notarized Power of Attorney dated 31/12/1998 as well as the Release Deed dated 2/7/1999. The learned APP on instructions of the Investigating Officer, state that the applicants shall also place before the Investigating Officer the following documents executed on 7/1/2000 :

(i) Affidavits (ii) Power of Attorney (iii) Memorandum of Understanding (iv) Partition agreement.

The learned counsel Mr.Mundargi state that by reporting to the Investigating Officer, the applicants shall tender the documents before him.

In the wake of the above, the documents being placed before the Investigating Officer, the custodial interrogation of the applicant is not warranted.

The order dated 20/7/2022 is made absolute.

In view of disposal of ABA, IA No.2353/2022 do not survive and is disposed off.
