By this petition, the petitioner seeks quashing of the First Information Report, registered vide C.R. No.115 of 2019 with the Mira Road Police Station, District. Thane (Rural), for the alleged offences punishable under sections 376 (2) (n) and 417 of the Indian Penal Code.

Learned A.P.P, on instructions, states that the Police after investigation have filed an "A" Summary Report in the said case on 17th August, 2019. He submits that the said "A" Summary Report has already been accepted by the concerned Court. Learned A.P.P SHAILAJA SHRIKANT SHRIKANT HALKUDE

906-WP-3181-2019.doc has tendered a photo copy of the letter dated 17th August, 2019 addressed to the Judicial Magistrate First Class, Thane and letter dated 22nd February, 2023, evidencing the same. 3.

Considering the said report, nothing survives for consideration in the aforesaid petition. The petition is accordingly disposed of as infructuous.

Needless to state that it is open for the petitioners to file a fresh petition, if occasion, so arises.
