Learned counsel for the applicant submits that despite the order dated 24th July 2017 expediting the trial of the applicant and directing the learned Judge to conclude the trial as expeditiously as possible and preferably within 9 months from the date of receipt of the order, the trial has not concluded. He submits that 5 witnesses have been examined till date and that the complainant has not appeared despite bailable warrants having been issued on two occasions.

Learned A.P.P states that 5 more witnesses are to be examined, including the complainant and the Investigating Officer. It is informed that SQ Pathan 1/2
ba.1545.18.4.doc the next date in the trial Court is 3rd September 2018. Learned A.P.P assures that the police will take all steps and enusre that the complainant is present before the trial Court so that his evidence can be recorded in the said case. Statement accepted.
The learned Special Judge shall take all appropriate steps to ensure the presence of the complainant and shall examine all other witnesses in the said case on day-to-day basis and shall make an endeavour to conclude the trial before 31st October 2018. Learned counsel for the applicant does not press this application in view of the order passed as aforesaid. Application is disposed of accordingly.
