This is an application for suspension of sentence and for Nilam Kamble Nilam Kamble Date: 2020.07.04 11:08:27 +0530 release of the applicants/accused on bail.

The applicants are respectively the accused No.2,6 and 7 who along with two other accused i.e. accused No.1 and 4 have been convicted under the relevant provisions of the Indian Penal Code and the Immoral Traffic (Prevention) Act 1956. The applicant Nos.2 and 3 (original accused Nos.6 and 7) have been convicted for the offences punishable under Section 373, 366A r/w 34 of the Indian Penal Code and Section 5 and 6(1) of the Immoral Traffic N.S. (Prevention) Act. The applicant No.1 (Accused No.2) has been convicted for the offence punishable under Section 4 of the ITPA Act. The applicants were all along on the bail during the course of the trial.

Having heard the learned counsel for the applicant and the learned Additional Public Prosecutor and further having regard to the fact that the applicants were on bail during the course of the trial.

ORDER

(i) The substantive sentence of imprisonment awarded to the applicant is hereby suspended during the pendency of the appeal, subject to the applicant furnishing P.R. Bond in the sum of Rs.25,000/-with one or two solvent sureties each in the like amount and on payment of fine, if not already paid.

(ii) For the present, the applicants are permitted to deposit cash surety of Rs.25,000/- before the RCF Police Station, Mumbai ,for a period of eight weeks, after which the applicants shall furnish P.R./S.B. bond as above.

(iii) The applicants shall furnish their permanent residential address along with proof before the RCF Police Station, Mumbai.

(iv) The Criminal Application is disposed of in the aforesaid terms.
