This matter was on our board for admission today. After we had heard the petitioner's counsel for some time, we inquired from the learned A.P.P. as to what steps have been taken in pursuance of the complaint filed by the petitioners/complainant's and the sister of the complainant. The learned A.P.P. sought time to take instructions. The matter was, therefore, posted at 3.00 p.m. After recess, the learned A.P.P. sought instructions from PSI Shirsath attached to the Azad Maidan police station and he has instructed him to make a statement that the charge-sheet has been filed in the Metropolitan Magistrate 37th Court, Esplanade, Mumbai.

wp-2683-14 In the light of the above, we have no doubt that if the complainant and the aggrieved party approaches the competent Court and raises all the grievances and issues which have been raised in the present petition, then, the said Court will take due note of the same. It can always pass appropriate orders in accordance with law. Once the charge-sheet has been filed, then, we need not keep this petition pending. All the contentions of all the parties are kept open.
