IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO. 961 OF 2019 IN CRIMINAL APPEAL NO. 181 OF 2017 Avinash Mahendra Angara ...
Applicant v/s.
State of Maharashtra ...
Respondent Mr. Shyamrishi Pathak for the applicant.
Ms. P.N.Dabholkar, APP for the State.
CORAM : DAMA SESHADRI NAIDU, J.
17th July 2019.
P.C.
The applicant is the appellant, who has suffered conviction for the offences under Section 143, 186, 353 r/w section 149 of IPC. As accused no.2, he suffered, among other things, three years RI. The rest of the shorter sentences are to run concurrently.
2. Pending the appeal, earlier this Court directed the applicant to get his passport renewed. Thereafter, this Court permitted him to go
2/2 907appa961.19.doc abroad through order dated 15th May 2018. Now once again the applicant seeks leave of this Court to travel to Greece and Turkey in August 2019 and Norway and Hungary the next month.
3. First, the petitioner has already been on bail; second, with the Court's leave the applicant had already been abroad. So I reckon that his bona fide intention to be available for adjudication of this appeal need not be doubted.
4. Under these circumstances, the application is allowed in terms of prayer clause (a).
