By this petition filed under Article 227 of the Constitution of India, the petitioner has impugned the order dated 27th May 2014 passed by the Joint Charity Commissioner, Pune granting sanction to sell the property under Section 36(1) (a) of the Bombay Public Trusts Act, 1950. 2.
A perusal of the record indicates that the petitioner has failed to deposit 30% of the amount offered by the petitioner within the time prescribed. Pursuant to the order dated 27th May 2014 passed by the learned authority, sale deed is already executed in favour of the respondent no.2. The respondent no.2 has already paid the entire consideration in respect of the sale. The petition is devoid of merits and is accordingly dismissed. No order as to costs. R.D. DHANUKA, J.
