After arguing for some time, learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. The application stands dismissed as withdrawn.

The learned Counsel submits that the applicant would surrender before the Magistrate on or before 16/7/2018. In view of this, the applicant stands protected till 5 p.m. on 16/7/2018. The learned Magistrate shall not be influenced by the withdrawal of the application under section 438 of the Code of Criminal Procedure, 1973 and shall decide the application on its own merits.

The application is disposed of accordingly.
