This is an application for anticipatory bail in connection with CR No.II-1612 of 2016 registered with MSEDCL Police Station, Kalyan for offence u/s 135 of Electricity Act, 2003. 2.

Learned counsel for applicant submits that prior to the receipt of notice the applicant had deposited 25% of the amount claimed by the complainant towards consumption of electricity and thereafter the applicant has paid the entire amount to the complainant. He has produced original as well as photocopies of receipts which indicates payment of Rs.90,651/-. The applicant has been granted interim protection by order dated 27th June 2018. In the circumstances, custodial interrogation of the applicant is not necessary. 3.

Hence, I pass following order :

ORDER

(i) Criminal Anticipatory Bail Application No.1243 of 2018 is allowed;

(ii) Interim order dated 27th June 2018 is confirmed; (iii) The applicant is directed to be released on bail in the event applicant is arrested in connection with CR No.II-1612 of 2016 registered with MSEDCL Police Station, Kalyan, on furnishing PR bond in the sum of Rs.15,000/- with one or more sureties in the like amount;

(iv) The applicant shall not tamper with evidence or pressurize the witnesses;

(v) The application is disposed off.
