After hearing the learned Counsel for the applicant, when this Court was not inclined to grant any relief, the learned counsel for the applicant, on instructions, seeks leave to withdraw the application with liberty to file a fresh bail application before the trial Court, if the trial pertaining to CR No. 431/2013 registered with Dindoshi Police Station, Mumbai, under section 376(d), 328, 506 (II) of IPC read with sections 4, 5 and 16 of the Protection of Children from Sexual Offences Act, 2012, culminated in Special Case No. 9 of 2014 pending on the file of learned Addl. Sessions Judge, (Borivali Division), Goregaon, Mumbai does not conclude within a period one year from today. Leave and liberty granted. The application is dismissed as withdrawn.
